Objective: To explain and analyze the theoretical foundations derived from the Holy Quran for the modern legal concept of “right to be forgotten”. This research seeks to answer the question of whether Quranic teachings have the necessary capacity to support the right of individuals to control and delete their past personal information in the digital space.
Method(s): The present research is organized with a descriptive-analytical method and with an interdisciplinary approach (jurisprudence, law and Quranic studies). The main sources of the research are the verses of the Holy Quran and authoritative interpretations, and relevant legal documents and articles have been used to analyze the legal aspects of the subject.
Result(s): The findings show that central Quranic concepts such as “seer” (protecting privacy and covering up mistakes), “tawbah” (the opportunity to return and erase the traces of the past), and “afwa” (passing and ignoring the past) form a coherent moral-legal framework. According to this framework, individuals have the right to be protected from the permanent labeling of their past mistakes and to have their human dignity preserved by providing them with the opportunity to start over.
Conclusions: The teachings of the Holy Quran have a high capacity for theoretical support and inferring the necessary principles for legislation in the field of the right to be forgotten in the digital age. These foundations can be used as a strong jurisprudential-moral support for the Iranian legal system in the face of this new challenge
