On the one hand, in the present age, the focus of the debate on freedom of speech is its limits, and on the other hand, the relationship between the components of tradition and modernity is one of the serious concerns of researchers and scholars. Therefore, this article intends to explore and delineate the boundaries of freedom of speech in international documents and their balance with the teachings of the Holy Quran as the first source of Muslim legislation, to examine the limits of freedom of speech and in this direction, considering that in the field of freedom of speech and its borders has been one of the oldest challenges of human beings in different periods of history with the structures of power and the ruling system. By focusing on the story of Moses in Pharaoh’s reign, this study discusses the boundaries which set out in international documents. Accordingly, and by considering the increasing number of regional and trans-regional meetings on freedom of expression and the increase volume of micro and macro limitations of freedom of speech in international documents, at first have mentioned the most important trans-regional treaties and then compares them with the Qur'anic teachings of the story of Moses prophet and Pharaoh. The results of this study indicate that among the limits of freedom of speech in these documents, only the limit of “protection of the rights of others” can be invoked, and other limits, despite many efforts in the international arena, are very general and vague limitations which threatens and restricts freedom of expression.}, keywords = {Borders of freedom of speech,Quran,International documents,Prophet Moses,Pharaoh}, title_fa = {موازنه حدود آزادی بیان در اسناد بین‌الملل و قرآن با تکیه بر واکاوی سرگذشت حضرت موسی (علیه‌السلام) و فرعون}, abstract_fa = {حق آزادی بیان در آموزه‌های اسلام و میثاق‌های بین‌المللی جزء حقوق سیاسی مدنی انسان‌ها و یکی از پذیرفته‌ترین اصول حیات اجتماعی بشر شمرده شده است. از یک‌سو در روزگار کنونی، محور مناقشه درباره آزادی بیان، حدود آن است و از سوی دیگر، ربط و نسبت میان مٶلفه‌های سنت و مدرنیته از دل‌مشغولی‌های جدی محققان و پژوهشگران می‌باشد. از این روی این مقاله بر آن است تا با کاویدن و سراغ گرفتن از مرزهای قلمرو کلان آزادی بیان در اسناد بین‌المللی و موازنه آن‌ها با آموزه‌های قرآن کریم به عنوان اولین مصدر تشریع مسلمانان، حدود و ثغور آزادی بیان را بررسی نماید و در این مسیر با توجه به اینکه در زمینه آزادی بیان و مرزهای آن، یکی از کهن‌ترین چالش‌های آدمیان در ادوار گوناگون تاریخ با ساختارهای قدرت و نظام حاکم بوده است، این پژوهه با تمرکز بر سرگذشت حضرت موسیu در حکومت فرعون، مرزهای پیش‌بینی‌شده در اسناد بین‌المللی را به بحث و نقد می‌کشاند. بر همین اساس و با در نظر گرفتن فزونی نشست‌های منطقه‌ای و فرامنطقه‌ای در باب آزادی بیان و حجم بالای مرزهای خرد و کلان آزادی بیان در اسناد بین‌المللی، ابتدا مهم‌ترین معاهدات فرامنطقه‌ای را ذکر کرده و سپس آن‌ها را با آموزه‌های قرآنی حکایت حضرت موسیu و فرعون مقایسه و نقد می‌کند. نتایج این پژوهش نشانگر آن است که از بین حدود آزادی بیان در این اسناد، تنها مرز «حمایت از حقوق دیگران» قابل استناد است و دیگر حدود، علی‌رغم تلاش‌های فراوان در عرصه بین‌المللی، محدودیت‌های بسیار کلی و مبهمی است که آزادی بیان را تهدید و تحدید می‌کند.}, keywords_fa = {مرزهای آزادی بیان,قرآن,اسناد بین‌المللی,حضرت موسی,فرعون}, url = {https://qd.razavi.ac.ir/article_545.html}, eprint = {https://qd.razavi.ac.ir/article_545_a78ffd77e15bb10ee263f31e382db865.pdf} }
